Justice Department to appeal ruling that Trump can't block Twitter followers

Buchwald's ruling came in response to a lawsuit filed by the Knight First Amendment Institute, which is based at Columbia University in NY and works to defend free speech.

Besides Trump, the case also names Hope Hicks, the former White House communications director, press secretary Sarah Sanders and Trump's social media director, Daniel Scavino.

Among the plaintiffs was Philip Cohen, who took to Twitter to celebrate his victory on Monday, writing in a tweet he was sure to tag president Trump in: "We whined".

President Donald Trump has filed an appeal of a federal court ruling that said he could not block people from his Twitter feed because it violated their constitutional rights, Politico is reporting.

Buchwald's ruling was in response to a First Amendment lawsuit filed against Trump in July 2017 by the Knight First Amendment Institute at Columbia University and several Twitter users.

"We're pleased that the White House unblocked our clients from the president's Twitter account but disappointed that the government intends to appeal the district court's thoughtful and well-supported ruling", he said in a statement.

Jameel Jaffer, a lawyer for the seven plaintiffs who sued, said the @realDonaldTrump account had unblocked the seven plaintiffs on Monday.

The plaintiffs argued that Trump's account amounted to a public forum - a "digital town hall" - in which the president makes official policy pronouncements and the public, by responding to his postings and to the tweets other people make in reply to them, engages in debate. According to the resolution, blocking users in social networks is unconstitutional and violates the first amendment prohibiting infringement on the freedom of speech.

After a hearing, the judge had suggested that Trump mute rather than block some of his critics.

The ruling stopped short of ordering Trump to unblock users, but one user who sued Trump tweeted that her access had been restored. If the court denies Trump's appeal, it may mean United States elected officials will have to keep their Twitter accounts open to all.
