Brian France, NASCAR chairman, arrested for DWI and criminal possession of oxycodone

Police in Sag Harbor, New York, arrested and charged NASCAR chairman Brian France with driving under the influence Sunday evening.

The 56-year-old auto-racing scion was behind the wheel of a 2017 Lexus when he blew through a stop sign in Sag Harbor around 7:30 p.m., police said.

TMZ reported that his blood alcohol level more than double the legal limit. He was arraigned in Harbor Village Justice Court and released on his own recognizance.

TMZ said it got a statement from NASCAR on the incident, saying it was aware of it, gathering facts and that it "take [s] this as a serious matter".

France reportedly name-dropped President Donald Trump during the process of the arrest.

France became NASCAR's Chairman and Chief Executive Officer in September 2003, taking leadership from his father Bill France Jr. His brother Jim France, who now serves as NASCAR's Vice Chairman and Executive Vice President, has assumed the role of interim chairman.

Police found oxycodone pills in his possession, officers said.

Aggravated driving while intoxicated in NY is when someone registers a blood alcohol content of 0.18 percent or higher. It is a Class A misdemeanor. In addition, a fine of up to $1,000 or twice the amount of the individual's gain from the crime may be imposed.

The Washington Post suggests TMZ's BAC report is true, in that under NY state law, a DWI charge applies to BAC of.08 or higher, and Aggravated DWI applies to BAC of 0.18 or higher; France was charged with the latter.

His arrest occurred mere hours after Chase Elliott prevailed at Watkins Glen International to earn his first Monster Energy NASCAR Cup Series victory.
