FDA Considering Ban on Flavored E-cigarettes

FDA puts e-cig makers on notice

"So, now, I'm able to tell them, 'I no longer smoke cigarettes'".

Now, Gottlieb is coordinating the largest scale initiative to enforce regulations against selling e-cigarettes to-date. Since 2017, FDA commissioner Scott Gottlieb has discussed e-cigarettes as a potential tool to wean adult smokers off cigarettes, although that benefit hasn't been proven.

Five of the biggest e-cigarette manufacturers - JUUL, Vuse, MarkTen, blu e-cigs, and Logic - must also report to the agency within 60 days with plans to address the concerns, or face penalties, it said.

The FDA is also targeting retailers who have sold e-cigarettes to minors.

"We see clear signs that youth use of electronic cigarettes has reached an epidemic proportion", Gottlieb said. "I think education is the answer to fixing the problem, just like how we have educated young people about alcohol and other tobacco products over the years", Delaney said.

"I certainly am in possession of evidence that warrants that", Gottlieb said, without disclosing the evidence.

In April, the Minnesota Department of Health and the Minnesota Department of Education sent a joint letter and toolkit to school districts across the state, warning them of the dangers of e-cigarettes and vaping products and providing them with resources for addressing the issue in schools.

State health department officials continue to be anxious about JUUL, a device that looks like a flash drive, which they say dominates more than 70 percent of the e-cigarette market.

"We need to go further", said Michael Bloomberg, the billionaire philanthropist who has worked for years to reduce tobacco use.

The appeal of e-cigarettes to teens is widespread and has raised alarms in other countries, including the UK.

Several of the manufacturers targeted by the FDA - Juul, MarkTen, Vuse, Blu and Logic - issued statements agreeing with the need to limit access to minors and announcing their willingness to work with the FDA to reach a solution.

During the 60-day waiting period, the FDA plans to investigate the five companies' marketing and sales practices, with possible "boots on the ground inspections", Gottlieb said. The company has more than two-thirds of the US e-cigarette market, according to Nielsen data. We think right now we can step into this market with a combination of enforcement actions against the places that we know kids are getting access to these products, which includes retail establishments that are selling them without putting proper restrictions in place or without carding minors, as well as the online sites, where we think that there are a straw purchases being made, where - where someone's going online, buying a lot of these products, and then reselling them to kids. E-cigs deliver lower toxin levels than regular cigarettes, but users can inhale more of the addictive stimulant nicotine.

However, he seemed reluctant to give up on flavored nicotine, because he said it appeals to adult cigarette smokers.

"In my view, they treated these issues like a public relations challenge rather than seriously considering their legal obligations, the public health mandate, and the existential threat to these products". "And they [teens] have adopted it", Gould said.
