Many are simply aghast at the elevation to the Supreme Court of Brett Kavanaugh and Neil Gorsuch, two exemplars of what has become known as "constitutionalist jurisprudence", which posits that the Supreme Court is limited to interpreting the text of the Constitution and must eschew any public policy-making role.

While speaking with CNN - often dubbed as the "fake news" network by President Donald Trump - Clinton turned the focus of her attack on beleaguered and newly confirmed U.S. Supreme Court (SCOTUS) Associate Justice Brett Kavanaugh. And he pointedly noted that these activities followed last year's shooting of GOP lawmakers at a morning baseball practice by "a politically crazed gunman". Only 50 percent of millenials made it to the polls in 2016, and only 37 percent of those voters elected the eventual presidential victor, Donald Trump.

Both parties have detected a surge in engagement among GOP and conservative voters since the nation's attention was grabbed by the confirmation battle over Kavanaugh, including allegations of sexual misconduct that he denied.

With Kavanaugh's ascension to the high court, Republicans, long dispirited by Trump's string of scandals and the prospect of losing their congressional majorities, are whooping it up.

In her October 5 speech announcing her decision to support Kavanaugh, Collins said: "Some of the allegations levied against Judge Kavanaugh illustrate why the presumption of innocence is so important". Retired Justice Anthony Kennedy, the 82-year-old jurist who Kavanaugh replaced, was in the courtroom, as were members of the new justice's family.

What's unclear is whether GOP unity is enough to preserve the GOP power in Congress.

The Kavanaugh hearings and eventual confirmation seem to have shifted the momentum in some U.S. Senate races around the country. The Senate now has 42 judicial nominees in the queue for floor votes, with nine more slated for Thursday consideration by the Judiciary panel.

McConnell went on to point the finger of blame at Democrats by referencing a comment 2016 Democratic presidential candidate Hillary Clinton made in a CNN interview. The majority of Democrats align themselves with the pro-choice movement - a woman's right to govern her own body - while most Republicans see themselves as pro-life - that life starts at conception. The day before the vote Collins spoke on the Senator Floor indicating that she intended on voting for Kavanaugh. She's about as strong as you can possibly be in Alaska.
