Weinstein wins dismissal of criminal charge for alleged sex assault

Justice James Burke dismissed one sexual-assault count against Harvey Weinstein on Thursday. That came after the Manhattan D.A.'s office slapped him with additional and more damning sex crime charges on July 2.

A lawyer for Evans insisted that even though this charge was thrown out, her client's claims are still truthful.

Prosecutors said actress Lucia Evans had given a witness a different version of the alleged sex assault from the one she had given them.

The detective allegedly hid information about the witness in dealing with prosecutors and allegedly cajoled the witness into not disclosing what she knew. Weinstein's lawyer Ben Brafman asked the judge to review all of the detective's work, but the judge has yet to respond to that request. "Nothing in this disclosure impacts the strength of the remaining case and the other five counts", she said, including the most serious count, for predatory sexual assault.

Brafman asserted again that Weinstein has not committed any crime and said he planned to file an application with the New York Police Department asking the detective who interviewed Evans to be banned from the case. Evans claimed that Weinstein promised an acting role if she gave him oral sex.

The letter also said prosecutors had recently obtained an email that Evans wrote in 2015 to the man she later married.

Weinstein's lawyer Brafman told the judge he believed Evans had lied to the grand jury and said he believed a police detective had attempted to influence the case by keeping a witness from testifying about her misstatements. Outside court, he suggested that Evans should be prosecuted criminally for perjury. She said she had initially met Weinstein at a restaurant in Manhattan earlier that summer.

"The integrity of these proceedings has been compromised", Mr Brafman said.

The collapse of part of the case against him could mean trouble for the prosecutor.

Ms Evans's lawyer, Carrie Goldberg, said her client's account of events had been accurate.

Assistant District Attorney Joan Illuzzi-Orbon told the judge that prosecutors wouldn't oppose dismissal of the count in the case involving Evans, reports CBS New York.

Weinstein had previously pleaded not guilty to the six sex crimes he's been charged with in NY, including two counts of rape. Weinstein has pleaded not guilty to all the charges.

"The account describes details of the sexual assault that differs from the account the Complainant has provided to our office", the letter states.

The dismissed charge was one count of criminal sexual act in the first degree based on allegations made by actress Lucia Evans, who publicly accused Weinstein past year of forcing her to perform oral sex in 2004, the Daily Beast reported.

New York Police officials poured on the pressure, too, saying publicly that they believed they had gathered ample evidence to make an arrest.
